Indiana Code 35-42-2-9 Strangulation

A person who, in a rude, angry, or insolent manner, knowingly or intentionally applies pressure to the throat or neck of another person, obstructs the nose or mouth of the another person, or applies pressure to the torso of another person in a manner that impedes the normal breathing or the blood circulation of the other person commits strangulation, a Level 6 felony.

 

However, the offense is a Level 5 felony if the offense is committed by a person against a pregnant woman; and who knew the victim was pregnant at the time of the offense; the person has a prior unrelated conviction for this offense; or the person has a prior unrelated conviction in any jurisdiction, including a military court, in which the elements of the crime for which the conviction was entered are substantially similar to the elements set forth in this section.
